On 25 May 2018, the new European Data Protection Ordinance (DSGVO) will enter into force. The updated Directives aim to strengthen consumer rights and make the handling of personal data even safer.

LSG & Kollegen GmbH takes data protection and security seriously as usual: therefore it is our duty to document the guidelines.

1 Who we are and what this policy is for

We respect the privacy of users of our website ("you", "your", "you", etc.) and are committed to protecting their personal data and information in accordance with applicable law. This Privacy Policy ("Policy") explains how, to what extent and for what purpose we collect and subsequently process personal data and information.

"Sensitive personal data" means personal data revealing racial or ethnic origin, political beliefs, religious or philosophical beliefs or membership of a trade union, as well as the processing of genetic or biometric data for the purpose of uniquely identifying a natural person, health or sex life or sexual orientation data of a natural person.

The personal data provided to us by you during registration will be stored and otherwise processed by us exclusively for the purpose of providing information services. We will not pass this personal data on to third parties. We will not merge, link or otherwise associate this information with personal data collected through other components of the site.

By registering and providing your personal data as part of this process, you expressly consent to the processing of this personal data as described above. (ii) Your career - declaration of consent

As part of our services, we specialize in the worldwide search, placement and integration of candidates for executive or similar management positions (each "candidate") on behalf of our clients ("client services").

If you are interested in becoming a candidate, you may provide us with information regarding your personal and professional background ("Candidate Information"), which we will consider in our client services at our sole discretion.

Candidate information is provided on a purely voluntary basis. Although the more information you provide to us, the better we can assess your potential suitability for a vacant executive or similar management position, we urge you not to provide us with candidate information that is likely to be of little or no relevance to normal hiring processes or that would not even be considered from a legal point of view. This applies in particular to sensitive personal data.

If and to the extent that you provide us with candidate information, we may contact you via any contact information you may provide in order to resolve any questions that may arise on our site or to obtain additional information from you. In addition, we may perform assessments of your professional profile and research information about your personal and professional life that is publicly available through social media services (e.g. Facebook, Google, LinkedIn, Twitter, etc.) or on the Internet, or that results from information previously disclosed to us by you, where that information may be relevant to your qualification for a particular leadership or similar management position. Any resulting information will be considered Candidate Information and will be processed as described below together with the Candidate Information originally provided by you to us through the Site.

Your candidate information is mainly processed by and on behalf of LSG. However, depending on how and where the client services are to be provided in your particular case, your candidate information may additionally be processed by or on behalf of our affiliated companies in countries worldwide (the "LSG network").

Your candidate information processed by LSG and/or other companies in LSG's network may include the following: (a) your contact details (name, address, telephone number, e-mail address, etc.), (b) your bibliographic data, (c) information on your vocational training and (d) your educational certificates, vocational qualifications and certificates. In addition, they could contain the following: (e) your professional history and information about your remuneration, (f) information about your suitability for vacancies with clients that we compile as part of our professional profile evaluations, (g) information about your personal and professional life that is publicly available through social media services (e.g. Facebook, Google, LinkedIn, Twitter, etc.) or otherwise on the Internet that may be relevant to your qualification for a particular leadership or similar management position, and (h) any sensitive personal information that you may disclose to us.

Your candidate information will be passed on to third parties as follows:

Your candidate information is stored in databases. The servers hosting these databases are operated by members of LSG's network or third party service providers acting on their behalf or under their instructions to operate the servers and they have access to them. Third-party service providers include Microsoft Corporation (India) Pvt Ltd. and domainfactory GmbH, Ismaning.

Through the databases, your candidate information is available to the consultants and administrative staff of the various companies in the LSG network for the purpose of providing client services.

We may, at our discretion, disclose extracts of your candidate information, such as your job-related training and career history, to certain clients to determine whether they are interested in you as a candidate for a vacancy in a management position or similar management position about which they have informed us. The information disclosed shall be limited to the information necessary for this purpose. We will not disclose all of your candidate information or otherwise present you in detail to a client without your prior separate and specific consent.

In this context, please note that various companies in the LSG network, most of the third-party service providers operating the database servers and some of our clients to whom we may be able to disclose extracts of your candidate information may be located in countries outside the European Economic Area (EEA) for which the European Union has not determined that they have an adequate level of protection of personal data, i.e. a level of protection of fundamental rights and freedoms substantially equivalent to that guaranteed within the European Union. Similarly, jurisdictions outside the European Union may find that the countries to which your candidate information, or parts thereof, is transferred in accordance with the foregoing, do not have an adequate level of protection. By providing your consent as described below, (a) you expressly and clearly agree that your Candidate Information or parts thereof, as described above, may be disclosed to recipients in countries or otherwise communicated to recipients in countries that are in compliance with applicable standards in the jurisdiction, where you reside or work, or from where you contact us, may have other, lesser or even inadequate protection of your personal information, and (b) you expressly and clearly waive protection in accordance with these standards for information disclosed or transmitted in this manner.

As part of the client services, your candidate information can be processed for the following purposes: (a) conduct searches for potential candidates on behalf of clients who have a vacancy in an executive or similar management position, (b) evaluate your suitability for vacancies with clients, (c) inform you of vacancies in executive or similar management positions that may be of interest to you, (d) introduce you to clients as a candidate and potential future member of your management team, and (e) review your educational credentials, professional qualifications and certificates. In addition, your candidate information may be processed for the following purposes: (f) research information about your personal and professional life that is publicly accessible through social media services (e.g. Facebook, Google, LinkedIn, Twitter, etc.).) or on the Internet, or which may arise from information you have previously disclosed to us, to the extent that such information may be relevant to your qualification for a particular leadership or similar management position, (g) providing integration services on behalf of a client with whom you have been hired by monitoring your integration with the client, talking to everyone involved and helping you to realize your full potential in your new role as soon as possible, (h) contacting you, after you have been hired from a client, as a client contact for hiring other candidates or as a source of information for potential candidates for third party clients, (i) ensuring that you will not be poached from one client on behalf of another client after hiring, unless you request to be considered for other vacancies, and (j) operating the databases in which your candidate information is stored.

At no time will your Candidate Information be merged, linked or otherwise associated with personal data collected through other components of the Site for purposes other than the provision of client services. Your Candidate Information will be processed until you revoke the consent you provided when you provided Candidate Information to us via the site. Upon revocation of your consent, we will delete your candidate information from all databases.

By providing your Candidate Information to us, you expressly consent to the processing of your Candidate Information, including any sensitive personal data that you may have disclosed to us, as described above. This includes in particular the transfer of your candidate information or parts thereof to countries that do not have an adequate level of protection for personal data.
